Terms of Service

1. Acceptance of Terms

By accessing or using GARD's website, products, or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.

2. Description of Services

GARD provides cybersecurity products and services including but not limited to security assessments, penetration testing, managed SOC, virtual CISO services, GRC platform, security awareness training, and educational content. The specific scope, deliverables, and timeline for each engagement will be defined in a separate Statement of Work (“SOW”) or Order Form.

3. User Obligations

You agree to:

  • Provide accurate and complete information when engaging our Services
  • Maintain the confidentiality of any access credentials provided
  • Not misuse the Services for any unlawful or unauthorized purpose
  • Notify GARD immediately of any unauthorized use of your account

4. Intellectual Property

All content, materials, and deliverables provided by GARD, including but not limited to reports, methodologies, software, and platform interfaces, are the intellectual property of GARD unless otherwise agreed in writing. Upon full payment, the client receives a license to use the deliverables for their internal business purposes.

5. Confidentiality

Both parties agree to maintain the confidentiality of any non-public information shared during the course of an engagement. GARD will not disclose client vulnerabilities, findings, or sensitive information to any third party without explicit written consent, except as required by law.

6. Limitation of Liability

GARD's services are designed to identify and reduce security risks, but no security assessment can guarantee complete protection against all threats. To the maximum extent permitted by law, GARD's liability for any claim arising from the Services shall not exceed the total amount paid by the client for the specific engagement giving rise to the claim.

7. Payment Terms

Payment terms are specified in the applicable SOW or Order Form. Invoices are due within the period stated. Late payments may incur additional charges. GARD reserves the right to suspend Services for accounts that are past due.

8. Termination

Either party may terminate an engagement in accordance with the terms specified in the applicable SOW. Upon termination, the client shall pay for all Services rendered up to the date of termination. Sections 4, 5, and 6 shall survive termination.

9. Changes to Terms

GARD reserves the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Algeria. Any disputes arising from these Terms shall be resolved in the courts of Algiers, Algeria.
